Business Court - SUMMARY OF AMENDMENT |

The September 2010 Amendments to the Business Court Rules (Atlanta Judicial Circuit Rule 1004) modify the Rules in two primary respects:
1. Removes the $1,000,000 amount-in-controversy requirement for cases that fall within the specifically enumerated Georgia Code sections listed in paragraph 3, but keeps the $1,000,000 amount-in-controversy in place for any other cases that the Business Court believes warrants the attention of the Court. This change allows the Business Court to hear cases such as books and records requests or petitions to hold stockholders’ meetings that are classic business cases that previously could not be heard due to the $1,000,000 amount-in-controversy requirement. 2. Requires lead counsel for each party to meet in person prior to the initial case management conference to discuss discovery and mediation, among other matters, and requires the parties to submit a proposed case management order to the Judge at the initial case management conference.
